How come the level 80 spells (the ones that were in game prior to SF) require the T9 rares? were those spells changed for the expansion? or is this a bug of some sort?

The L80's are actually T9.  They were in the L79 book back when the max was 80.  They were moved to their own book when the level upped to 90, making them properly T9.  The L90 spells are in the L89 book.  When the game shifts to L100, the spells will move books again, making the L90 spells properly T10.

This happened when the game went from L50 to 60, 60 to 70, etc.  Each level raise shifted spells around in their books at the end tier.  Every now and then you can find some which take the wrong rare, one that was missed in the shifting.

And I've noticed when making my dirge's spells, the level 60 ones still took alkali. That is a shame because the alkalis cost way more than spongies on my server.
