OK, I went to http://www.riseofkunark.com/ to see if there was anything posted and I was shocked to see what is there. It basically says that it belongs to a guild and it is under construction.

In the www boom, people would buy domain names and "randsom" them off to companies for big bucks. If I remember correctly, that has actually become illegial. Do you think that is what has happened here, or do you think there is a legitimate guild called rise of kunark?

I wouldn't think they'd have anything up yet since they havn't even announced it yet.

Well, I did a guild search on EQ2Players and it didn't turn up a guild named "Rise of Kunark" or anything mentioning Kunark.

Well, I knew nothing would be on it, that is not what the post is about. I am wondering if someone saw the patent posting and immediatly bought the domain to sell at a later date.

If SOE had decided on the Rise of Kunark name for the next expansion and did not reserve the domain name, well that is just dumb.

The Domain riseofkunark.com has been registered after the trademark. It depends, if SOE decides tu sue the owner they could, if they decide to ask him polite they could, if they decide to pay him a few bucks (what I dont think they would) they could in either case SOE has a legal right on this domain name. Post Scriptum The guy who registered the domain name is either greedy or dumb (I guess both) cause the only thing he is getting from this is a delay for the official website.

Has anyone from SoE stated that the expansion would be called Rise of Kunark? I'd guess that they would have registered some possible names long ago. Since Kunark is a registered trademark though I'm pretty sure if they really wanted the name it would be theirs. But don't quote me... I'm speculating on speculation.

don't even think domain ganking is legal anymore if someone holds a 'similar' trademark.... not a lawyer, but hey.

Actually all they need to do is contact the registrar and explain the situation. The most common action at this point is for the registrar to transfer to the domain to SOE once they establish sufficient existance as a business and a relationship to that name. The best part is that since SOE can prove when the trademark was registered, the individual really has no chance of keeping the domain.

This is a brief overview of the actual process...but my company has help several businesses over the year reaquire domain addresses that they allowed to lapse into redemption, were unable to transfer from a previous web host or developer, and in a few cases domains that were identical but with a "-" or an "s" that a third party was using to "steal" visits from the companies website.

Sad that someone thought this was a payday.

ya since SOE has the trademark on RoK before the website was created, all they have to do is go to the registart of the name and say they got the trademark and they get the name. The guy could fight it, but at this point there no way he would win.

SOE has control over the domain as of May 5th. I guess it is official now.

I just typed a long "legal" response. But in all reality I'm glad. I'm so sick of the army of lawyers soe has and how they turned the game into a court room. I'm glad!
